Dependent Adult Applications
Requirements & Process:
This is required when a person who does not have the mental capacity to care for themselves reaches the age of 18. It is also required when a previously healthy adult loses the mental capacity to care for themselves due to an accident or illness, and that person does not have both a Personal Directive and an Enduring Power of Attorney already in place.
It is a fairly lengthy and involved process, and must be renewed every five or six years. The Court appoints someone to be the guardian and trustee of an incapacitated adult, and the person appointed may not be someone the Dependent Adult would have chosen.
